Competition Terms & Conditions of Use
Please read below for the official Competition Rules & Terms of Use. You must explicitly accept these terms at the time of online submission in order to enter the competition.
General Conditions Web Site Terms of Use Official Rules

General Conditions

The application must have been created solely by the entrant, and the entrant must have a non-restricted right to submit it in this Competition. The entry cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as entrant’s original creation. Entry may not be offensive, as determined by judges in their sole discretion. Any entrant whose work includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to depictions of buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor’s use of such entry, in a form satisfactory to judges. Entries not complying with all rules are subject to disqualification. By entering, each entrant grants to Microsoft (including its affiliates, employees, agents, and contractors), IDSA and the Competition Judges an irrevocable, royalty free, fully paid up, worldwide license to use, review, assess, test and otherwise analyze the Application and all its content in connection with this Competition. Microsoft shall be free to use for any purpose the residuals resulting from access to or work with the Entrants’ Applications. The term “residuals” means information in intangible form, which is retained in memory by persons who have had access to the Applications, including ideas, concepts, know-how, or techniques contained therein. Microsoft shall not have any obligation to limit or restrict the assignment of such persons or to pay royalties for any work resulting from the use of residuals. However, this paragraph shall not be deemed to grant to Microsoft a license under the Entrants’ copyrights or patents. The intellectual rights of the resulting designs remain the property of those directly responsible for the design and its submission. Microsoft retains an exclusive first right of refusal on acquisition of any of the resulting designs submitted into the competition at negotiated rate. Should Microsoft or related party wish to acquire the rights to produce or otherwise utilize a design beyond the immediate scope of the Competition, those involved in the direct results of the work agree to assign all rights, including patent rights, in the work to Microsoft or the related party for compensation at a level comparable to a normal professional fee. IDSA shall not be involved in any dispute and shall be held harmless and free of any liability in any dispute regarding intellectual property rights or compensation or payment for any professional competition or program that it endorses.

The Applications or any part of the Entry must not be, in whole or in part, governed by an Excluded License. An Excluded License is any license that requires, as a condition of use, modification and/or distribution of software subject to the Excluded License, that such software and/or other software combined and/or distributed with such software be (a) disclosed or distributed in source code form; (b) licensed for the purpose of making derivative works; or (c) redistributable at no charge. Permission is also granted for Sponsor to promote winning entries in perpetuity in any medium it may see fit including, but not limited to, website, television, radio and/or printed materials. Entrants shall not receive any compensation or credit for use of entries, other than that disclosed in these rules. Entrants agree to be bound by the terms of these conditions.

Official Rules

The laws of the State of Washington in the United States govern this Competition. All federal, provincial, state, and local laws and regulations apply. Potential winners may be required to execute and return an Affidavit of Eligibility and Liability Release and where legal, Publicity Release, within 14 days following the date of issuance of notification. Non-compliance within this time period or return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. Acceptance of prize constitutes permission for Microsoft Corporation, IDSA and their agents to use winner’s name and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants release and hold harmless Microsoft Corporation and its respective subsidiaries, affiliates, advertising and promotions agencies, prize suppliers, and all of their employees, officers, directors, shareholder’s and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Competition, the use of any entry, or the acceptance or use of any prize won.

The Challenge
Rethink the Windows-based PC experience today and the role it plays in people’s lives. Envision how the digital lifestyle—from personal productivity at work or home, to entertainment, mobility, lifestyle and form—all play a part in development. Think big, be bold, and inspiring, but pay attention to sustainable technologies, and ecological and environmental innovation.

Publicity & Exposure
  • Microsoft, as sponsor, will promote finalists’ and winners’ designs in press and industry outreach, as well as sustain the website after launch as a resource for the industry at-large and enthusiast browsing.
  • Winners will be showcased online on Microsoft properties including but not limited to startsomethingpc.com, with attribution.
  • At the completion of judging, the site will serve as a virtual directory of ID talent, connecting businesses with entrants only with the entrant’s explicit opt-in during time of submission.
  • Winners will be showcased jointly by Microsoft and the IDSA at the 2006 International Consumer Electronics Show (CES) in Las Vegas, Nevada USA.


Competition Award Categories & Rewards
One (1) winner will be selected in each of three (3) categories:

  • Judge's Award - Prize $50,000 USD
    Selected by a distinguished panel of IDSA-member judges from the International PC and industrial design community.
  • Chairman's Award - Prize $50,000 USD
    Selected by Bill Gates, Microsoft Chairman and Chief Software Architect, with the assistance of his advisory committee.
  • Public's Choice Award - Prize $10,000 USD
    Selected by the public from among all approved entries via the virtual showroom in mid- to late November.


Eligibility
  • Open to designs and designers worldwide in Microsoft® Passport Network-supported countries and regions.
  • Entering party, either individual or team representative must obtain a valid Microsoft® Passport Network.
  • Open to students in any industrial design program.
  • Student entries can be submitted in any category, even if the design is in research or corporately funded.
  • Employees of organizations and students at schools represented on the jury may not participate in the competition.
  • Entries may be sponsored by corporations, but no entries may be in production.
  • Designs must adhere to entry kit criteria. Entrant names and the names of their consulting firms or schools may not appear anywhere in the entry kit.
  • Use of Microsoft and/or IDSA and/or ICSID branding, the Microsoft Windows flag, and/or copyrighted Microsoft elements not provided for in the entry kit are strictly prohibited and may result in disqualification.


Next-Generation Windows OS PC Design Competition Timeline
  • April 25, 2005: Competition announced, entry kits available for download.
  • May 18, 5:01 pm EST through October 3, 2005, 5:00 pm EST: Online entry submission is open. Entries must be submitted online by 5:00 pm EST. Microsoft must also receive a minimum of one printed picture and any supporting material by 5:00 pm EST on October 10, 2005.
  • November, 2005: Finalists and Winners in Judge's Award and Chairman's Award categories are notified by IDSA and Microsoft.
  • November, 2005: Public's Choice Award voting begins at startsomethingpc.com. Limit one vote per person and/or per Microsoft® Passport Network account.
  • December 15, 2005, 5:00 pm EST: Voting for Public's Choice closes.
  • January, 2006: Winners are announced to the public at 2006 International CES.
  • February, 2006: Entry prizes are awarded via IDSA representatives.


Design Categories
Designs for practically any Windows-based PC design concept may be entered; however challenges of manufacturability should be considered. Entrants may submit one unique entry per category based on primary role/benefit of the design as related to the digital lifestyle challenge and reinforced in the essay questions:

  • Personal Productivity (at work, at home or on the go)
  • Entertainment
  • Communication & Mobility (at work, at home or on the go)
  • Living and Lifestyle**


Judging Criteria
The Judge's Award, Chairman's Award, and Public's Choice Award* judgments are based on the following five criteria:

  • Innovation: is the design new and unique?
  • User Experience/Interaction: does the design make the PC easier to use?
  • Aesthetics: does the appearance enhance the emotional appeal of the product?
  • Technical ability: is the design enhanced with new technologies?
  • Ecology: is the design environmentally responsible?

Consideration given to the challenges of manufacturability including thermal cooling and noise reduction may also be considered as a part of the general judging criteria.

Peripheral component design concepts (e.g. Cell Phone, Digital Media Receiver, Printer, Portable Media Player, etc.) are not required, but may be included with concept designs to help aid in answering the challenge statement.

Judging Process
  • The judging is blind: the designers, their names and the names of their consulting firms or schools may not appear anywhere in the entry kit other than the Design Credit List.doc. Failure to abide by this rule results in immediate disqualification.
  • Entries are not to be considered approved until 1) A confirmation email with unique entry number is received, noting that all entry kit requirements have been met and 2) CD/DVD submission of print-ready images has been received.
  • Up to three finalists will be selected in each design category at the discretion of the judges.
  • Judges, their immediate families or the companies they are employed by may not enter work.
  • Each entry is scored on its own rating sheet based on how well it meets the criteria of design excellence described above.
  • All criteria receive equal weight in scoring and award selection.
  • Windows Media Video (WMV) of the designs in use, as well as photos, augment the essay information the judges review in scoring each entry.


Submission Process and Deadline
  • Submission will take place in two parts: 1) Online Submission and 2) Supplemental Mailing
    • Online submissions will be open between May 18th 2005 and 5:00pm EST, October 3, 2005. Details on online submission criteria can be found in the Entry Kit.
    • Once a submission is approved, a confirmation email will be provided with an entry ID number and a postal address to send supplemental material including essay question responses in English, CD/DVD submission of print-ready images (300 dpi or higher) and/or videos supplemental information must be received within a week of submission. Please see Entry Kit for complete details.


Please do not send your entry to IDSA's office or Microsoft. You must submit your entry online between May 18, 2005 and 5:00 pm EST, October 3, 2005, followed up with print and supplemental materials mailed to Microsoft office by October 10, 2005 at 5:00pm EST. Please factor this deadline into your submission.

By submitting your entry, you agree that any or all of the material may be published and utilized by the Industrial Designers Society of America (IDSA), Microsoft, and any other party authorized by IDSA and/or Microsoft in connection with the awards.

All decisions by the jury and/or Microsoft in conjunction with IDSA are final.

Optional: Digital Video Guidelines, Tips & Suggestions
If submitting a video to support your entry, you cannot submit a website link; you must send two (2)copies of the video in Windows Media Video 9 Series (WMV) format at a minimum 640x480 screen resolution, on two (2) separate CDs (or DVD-Data media) for the jurors to review. Media must be standard machine-readable on Windows XP OS. Please send this to the IDSA office noted in your confirmation email to be received by October 1 2005, 5pm EST, in order to be considered. Please be sure to include your entry kit number on the CDs as well as the envelope.

All rights to music or other content provided in said videos are the responsibility of the entrant to secure, and the entrants hold Microsoft Corporation and IDSA harmless for failure to receive those rights. By submitting a video with synchronized music, you agree that the redistribution rights to the video and audio have been secured for personal and promotional use.

Tools for creating Windows Media Video can be found at http://microsoft.com/windowsmedia as well as for popular video editing products such as Adobe Premiere. Photo Stories created with Windows Photo Story 3 will also be accepted.

**Living and lifestyle category entries provides for a more free-form exploration, reducing emphasis on manufacturability as a judging criteria to focus on more forward-looking scenarios.

NO UNLAWFUL OR PROHIBITED USE.

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Microsoft server, or the network(s) connected to any Microsoft server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Microsoft server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.

USE OF SERVICES.

The Services may contain e-mail services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets and/or other message or communication facilities designed to enable you to communicate with others (each a "Communication Service" and collectively "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using the Communication Services, you will not: Use the Communication Services in connection with surveys, Competitions, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise). Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information. Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consent to do the same. Use any material or information, including images or photographs, which are made available through the Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party. Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another. Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Services specifically allows such messages. Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner. Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded. Restrict or inhibit any other user from using and enjoying the Communication Services. Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service. Harvest or otherwise collect information about others, including e-mail addresses. Violate any applicable laws or regulations. Create a false identity for the purpose of misleading others. Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the Services or other user or usage information or any portion thereof. Microsoft has no obligation to monitor the Communication Services. However, Microsoft reserves the right to review materials posted to the Communication Services and to remove any materials in its sole discretion. Microsoft reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever. Microsoft reserves the right at all times to disclose any information as Microsoft deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Microsoft's sole discretion. Always use caution when giving out any personally identifiable information about yourself or your children in any Communication Services. Microsoft does not control or endorse the content, messages or information found in any Communication Services and, therefore, Microsoft specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Services. Managers and hosts are not authorized Microsoft spokespersons, and their views do not necessarily reflect those of Microsoft. MATERIALS PROVIDED TO MICROSOFT OR POSTED AT ANY MICROSOFT WEB SITE.

Microsoft does not claim ownership of the materials you provide to Microsoft (including feedback and suggestions) or post, upload, input or submit to any Services or its associated services for review by the general public, or by the members of any public or private community, (each a "Submission" and collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting ("Posting") your Submission you are granting Microsoft, its affiliated companies and necessary sublicensees permission to use your Submission in connection with the operation of their Internet businesses (including, without limitation, all Microsoft Services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; to publish your name in connection with your Submission; and the right to sublicense such rights to any supplier of the Services. No compensation will be paid with respect to the use of your Submission, as provided herein. Microsoft is under no obligation to post or use any Submission you may provide and Microsoft may remove any Submission at any time in its sole discretion. By Posting a Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in these Terms of Use including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions. In addition to the warranty and representation set forth above, by Posting a Submission that contains images, photographs, pictures or that are otherwise graphical in whole or in part ("Images"), you warrant and represent that (a) you are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by these Terms of Use and the Services, (b) you have the rights necessary to grant the licenses and sublicenses described in these Terms of Use, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these Terms of Use, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such Images. By Posting Images, you are granting (a) to all members of your private community (for each such Images available to members of such private community), and/or (b) to the general public (for each such Images available anywhere on the Services, other than a private community), permission to use your Images in connection with the use, as permitted by these Terms of Use, of any of the Services, (including, by way of example, and not as a limitation, making prints and gift items which include such Images), and including, without limitation, a non-exclusive, world-wide, royalty-free license to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Images without having your name attached to such Images, and the right to sublicense such rights to any supplier of the Services.
